JD Vance H-1B visa remarks: why he walked back 'indentured servants', and what it means for Indian techies

US Vice President JD Vance now says his 'indentured servants' line about H-1B workers was 'imperfect' and 'on me'. India had called it deeply offensive. Here is what he said, what India said, and what the green card (PERM) freeze on eight companies actually changes.

TL;DRThe short version

  • The walk-back: At a CBS News town hall on Saturday (US time), JD Vance said that to the extent his 'indentured servants' rhetoric was imperfect, 'that's on me', and that it was 'not a criticism of the H-1B holder' but of companies and the visa system.
  • India's objection: On 9 October, the MEA called the description 'unwarranted' and 'deeply offensive', citing its painful historical and colonial connotations.
  • The policy hasn't changed: The US Labor Department's 8 October freeze on new and pending PERM green card filings involving TCS, Infosys, Wipro, HCL, Cognizant, Capgemini, Microsoft and Adobe still stands, with no end date announced.
  • If you work for one of the eight companies, read India's MEA statement on what the PERM freeze does and doesn't affect, then check with your employer's immigration team: MEA media briefingsMEA: the PERM suspension does not, by itself, affect existing H-1B visas or the status of H-1B holders and dependents, but green card processing for eligible employees of the affected companies could be hit.

Short answer: JD Vance has softened his words, not his policy. At a CBS News town hall on Saturday (US time), the US Vice President said that if his description of H-1B workers as "indentured servants" was imperfect, "that's on me", and that he meant it as a criticism of companies and the visa system, not of H-1B holders. India's Ministry of External Affairs had called the phrase "deeply offensive". But the 8 October freeze on green card (PERM) filings involving TCS, Infosys, Wipro, HCL, Cognizant, Capgemini, Microsoft and Adobe is still in place.

What Vance said at the town hall

The question came from an Indian immigrant who became a US citizen five years ago, according to the Times of India. Vance's answer, as reported by TOI and Hindustan Times:

  • "To the extent that my rhetoric has been imperfect here, that's on me."
  • His "indentured servitude" line was "not a criticism of H1B visa holders" but of companies that, he said, can lay off an American worker, bring in a visa holder, and hold the threat of losing the job (and the right to stay) over them.
  • He invoked his family: his wife Usha Vance is the daughter of immigrants from South India, and he said he loves his "mother-in-law and father-in-law who immigrated from South India".
  • He said his goal was "not to dehumanise any immigrant", and that the US needs a "balanced" immigration system.

What he originally said, and why India objected

On 8 October 2026, at a White House press conference on visa fraud, Vance said, as quoted by ANI: "You bring in indentured servants from outside the country, you lay off American workers and, if you're a corporation, you make a ton of money by undercutting the wages of American workers." He also claimed H-1B workers earn $20,000 less than an American in the same role, and $48,000 less if brought in by an outsourcing firm. Those are his figures, not independently verified.

On 9 October, MEA spokesperson Randhir Jaiswal responded. The ministry said such descriptions were "unwarranted", ignored that Indian professionals in the US are "highly educated and skilled contributors" to its economy, and that "resorting to terminology that carries painful historical and colonial legacy connotations is deeply offensive". The word carries weight in India because of the colonial-era indenture system that took Indian labourers to plantations abroad.

The policy that hasn't changed: the PERM freeze

The remark came at the same press conference where US Labor Secretary Keith Sonderling announced that the Labor Department would "not accept any new or process any pending" permanent labour certification (PERM) applications involving eight companies.

What was announced on 8 Oct
Companies Cognizant, Infosys, Tata Consultancy Services, Wipro, HCL Technologies, Capgemini, Microsoft, Adobe
What's frozen New and pending PERM applications, the first step of an employer-sponsored green card
End date None. Vance said it would last "as long as it needs to"
Reason given Alleged H-1B and PERM abuse; Microsoft and Adobe cited for "multiple active federal investigations" (CNBC)
Vance's walk-back Changes none of this

What it means if you're on an H-1B

India's MEA set out the government's reading on 9 October:

  • PERM is separate from the H-1B programme. The suspension "does not, by itself, affect the validity of existing H-1B visas or the status of H-1B visa holders and their dependents."
  • Green cards are where the hit is. There "could be some impact on the permanent-residency/Green Card process of eligible employees of the affected companies."

US officials did not say, at the time of the announcement, whether labour certifications that were already approved are affected, according to immigration-law explainers. If your green card case runs through one of the eight companies, your employer's immigration team or lawyer is the only one who can tell you where your file stands.

Why searches for "jd vance h-1b visa remarks" spiked

India's news cycle woke up to the town hall clip on Sunday. Hindustan Times, Times of India and Zee News all led with the "that's on me" and "Indian in-laws" lines, and "jd vance h-1b visa remarks" showed up in Google's Trending Now feed for India by late afternoon. For the many Indian families with someone on an H-1B, the question behind the search is simple: has anything actually changed? So far, only the tone.

What to watch next

  • Any formal notice from the US Labor Department on how long the PERM suspension runs and whether it covers already-certified cases.
  • Further MEA comment at its weekly briefing.
  • We'll update this page if the freeze is lifted, narrowed or extended to more companies.

Myth vs fact

01

Myth Vance has apologised and the US has reversed the green card freeze.

Fact No. Vance said his rhetoric may have been imperfect and 'that's on me', but the Labor Department's PERM suspension on the eight companies has not been lifted, and no end date has been given.

02

Myth H-1B visas of TCS, Infosys and Wipro employees have been cancelled.

Fact No. India's MEA says the PERM suspension does not, by itself, affect the validity of existing H-1B visas or the status of H-1B holders and their dependents. The impact is on the green card (permanent residency) process.

03

Myth Vance withdrew the word and said H-1B workers aren't indentured servants.

Fact Not quite. He said 'indentured servitude' was a criticism of companies and of a visa system that ties a worker's status to the job, not of the workers themselves.
