What the EPFO higher pension private sector verdict says
There is no new Supreme Court verdict. The ruling people are searching for is the Bombay High Court order of 19 October 2026. EPFO had rejected the retirees' joint options because the rules of their employers' in-house PF trusts (these companies are "exempted establishments") capped the employer's contribution at the wage ceiling, or didn't provide for it at all.
According to LawTrend's report, the court said trust rules govern the provident fund, not pension rights under the EPS. Where the employer's records are missing, EPFO has to verify the facts some other way, including by hearing the employee. The court also said EPFO's pending Supreme Court appeal against the Madras High Court's ruling is no reason to keep retirees waiting indefinitely.
As of 25 October 2026, no EPFO appeal against the Bombay order or official EPFO response had been reported.
Who benefits and who doesn't
- The petitioners: they get direct relief within 8 weeks.
- Others rejected on trust-rule or missing-record grounds: you can cite this ruling, and similar ones from the Calcutta (November 2025), Karnataka (May 2026) and Madras (around July 2026) High Courts, in an appeal or a writ petition. The Allahabad High Court's Lucknow bench also quashed EPFO's rejections for HAL retirees in May 2026.
- People who never applied: the ruling doesn't reopen the 2023 window.
To be eligible, you must have contributed on actual wages above the ceiling (₹5,000, ₹6,500 or ₹15,000, depending on the period) and exercised or validated the joint option before the deadline. The ceiling may be changing too: see our explainer on the EPF wage ceiling of ₹25,000 and your payslip.
How much more pension? A worked example
The basic EPS formula is pensionable salary × pensionable service ÷ 70. Pensionable salary is your average salary over the last 60 months. Take someone with 30 years of service:
| Pensionable salary | Monthly pension |
|---|---|
| ₹15,000 (ceiling) | ₹6,428 |
| ₹50,000 (actual wages) | ₹21,428 |
These figures are for illustration only. EPFO calculates service before and after 1 September 2014 separately (pro-rata, under Para 12), and the government defended that method in Lok Sabha on 20 July 2026. Your actual pension is usually lower than this simple calculation. You also have to pay the amount in EPFO's demand letter. Use the dues calculator on the portal to get your own figures.
What to do next
- Check your status on the Pension on Higher Wages portal.
- If you have a demand letter, pay within 3 calendar months of the date it was issued. Retirees then file Form 10D to get their PPO (pension payment order).
- If you were rejected on trust-rule or missing-record grounds, speak to a lawyer about an appeal or writ petition that cites these High Court rulings.
- Keep an eye on EPFO's Supreme Court appeal and the CBT meeting expected on 19 November 2026.
- Watch out for scams. If anyone asks for an OTP or a "processing fee", report it using our 1930 cyber fraud helpline guide.
EPS-95 was replaced on 29 June 2026 by the Employees' Pension Scheme, 2026. According to BusinessToday, the new scheme protects actions already taken under the old one, and the minimum pension is still ₹1,000. More money-rule explainers are on the KyunTrend homepage.
